Defendant Barratt Homes Ltd
Summary Part of a tree felled on a Member of public (MOP). Company being prosecuted for breaches of Health and Safety at Work etc Act Sec 3(1), Construction (Design and Management) Regulations 11(1) & 15(4). MOP taken to hospital with head injuries but released same day - injuries could have been more serious. While investigating this incident it came to light that there was no h & s plan for job. Prosecution proposed because standards far below benchmark and MOP injured.

Summary Carpenter died after falling from 1.8 high scaffold tower. No edge protection. HSE guidance criticised by company & coroner.
  This case did result from the investigation of a fatality.

Summary HSWA s2: MHSWR r11: Back filling trench where method statement called for 2100mm trench boxes to be used in 1500mm (max) trenches both as side wall support & wheel stop. Injured person was in trench (should have been outside) when material delivered trench and dumper rolled into trench and onto injured person.
